Purchase contract

Any pro forma sent to the customer has a duration of 7 working days from the indicated date.If after this period no payment has been made to confirm the order, this order will be considered as void and any bid applied will have no more force.
All purchasing contracts that users can perform on the website will be made with LUXURYLOFT DECORACION, S.L.
The parties have expressly agreed to a reservation of title in favour of LUXURYLOFT DECORACION, S.L., so that ownership of the proceeds of the sale do to transfer not to the user both LUXURYLOFT DECORACION, S.L. has not received all of the corresponding price (and the payment of VAT and shipping charges that apply) reserving until then the property and the legal actions that correspond to the reservation of title.
Where a manufacturer notifies LUXURYLOFT DECORACION, S.L. the selected command, or a product of purchase is not available, LUXURYLOFT DECORACION, S.L. will notify the circumstances to the customer and he will be reimbursed the total amount of purchase, or the part that corresponds to the product in question as well as the shipping charges that apply, by bank transfer.
LUXURYLOFT DECORACION, S.L. has a period of 7 working days for the refund from the notice to the client of such unavailability of the product. In no case it will be awarded the customer to compensation, discounts, etc... for this reason.
The customer has 3 days to change their opinion or cancel the order.
The acceptance of the proforma invoices through the payment of 50% of the same, implies the total acceptance of the conditions laid down therein. LUXURYLOFT DECORACION, S.L. with V.A.T. nº: ESB02586386 reserves the right of non-refund of the amount by the refusal of the client to take charge of the goods.
LUXURYLOFT DECORACION, S.L. undertakes to repair or change any damage caused in manufacturing or manipulation in the transport of the goods, in any case the amount will be refunded, whenever it communicates through email and with pictures, within a period of 48 hours from the moment of the delivery at the customer's location.
For any special measure, if the manufacturer deems it appropriate, a signed acceptance will be requested from the customer, exonerating both the manufacturer and LUXURYLOFT DECORACION, S.L. from any responsibility. The photographs displayed on this website have no contractual value.
Depending on the resolution of each screen, there may be differences in the colours of the finishes offered. The manufacturers with whom we work on our site reserve the right to make any changes to the products offered, provided that this involves an improvement in the stability and quality of the furniture.
When delivery and assembly (if this is included) of the items, fitters will have complete freedom in handling them to ensure the anchoring, stability and fixing of the item, provided that this does not affect the visible aesthetics of the item.

Our deliveries are made by specialized carriers in furniture. Delivery in UK will be done on street-level front-door of the customer's home address. Contact us for more information or for other destinations.

We inform that the furniture assembly is only available in Spain and in the Balearic Islands.

INFORMATION: For sales to Canary Islands, the IGIC taxes will be paid by customer and also for sales to Ceuta y Melilla, the IPSI taxes will be paid by customer.

Payment

The client will pay orders through PayPal (+5% for administration fees), bank transfer or credit card as specified in the paragraph "payment terms".

Delivery of the material

LUXURYLOFT DECORACION, S.L. is committed to deliver the material of the order in perfect condition, at the address indicated by the customer during the purchase process.

This is an internal UK regulation and it is mandatory.


Our deliveries are made by specialized carriers in furniture. Delivery in UK will be done on street-level front-door of the customer's home address. Contact us for more information or to other destinations.
In case of not being able to deliver the order on the scheduled day and hour due to the customer's absence or access difficulties not previously notified, an additional cost equivalent to a new delivery will be charged to the customer.
In case it is not possible to deliver the furniture through the lift or by the stairs, it will be necessary a furniture elevator. The customer will have to pay this extra cost.
It is the responsibility of the client to carry out the delivery to the provided address during working hours which transport companies distribute their deliveries.
IMPORTANT: If for any reason the customer delays the dispatch of the order for our international carrier, after having being notified of the dispatch, for more than 20 days LUXURYLOFT DECORACIÓN, S.L. reserves the right to charge for the storage of the furniture from the 21st day.
This will involve an extra cost of EURO 50.00 per week.
The customer will have to pay the corresponding extra storage costs before the shipemnt of the order.
Once the completed purchase of the order process and the payment of the total amount received,
LUXURYLOFT DECORACION, S.L. can then send the material to the customer. LUXURYLOFT DECORACION, S.L. cannot compromise themselves to send the products with a date to be determined because the shipment date will depend on in last instance by the carriers and manufacturers. Please note that the manufacture of the products offered on the web, is still on demand, time manufacturing and delivery time is estimated at between 45 to 55 working days for standar sizes. For special sizes, about 60/70 working days.
The delivery time of your order may be subject to significant variations due to reasons beyond our control, such as manufacturing or transport delays, as weel as any other extraordinary cirmumstances.
Delivery will be deemed to be carried out from the moment where material will be made available from the client to the delivery address indicated. The risk with respect to equipment (loss, damage, scratches, shock or theft) will be transmitted to the client from the moment where the furniture will be at its disposal, in accordance with the provisions of the present general conditions.

If the delivery of your order involves additional costs (customs duties, taxes or any other costs), in accordance with the regulation in force in your country of residence, these will be fully at the charge of the customer.

If the product(s) sent is (are) damaged on delivery, the customer must indicate this on the delivery note from the transport company and inform immediatly LUXURYLOFT DECORACION, S.L. in writing an e-mail within 24 hours.(e-mail: luxuryloft.postventa@gmail.com), which will indicate the procedure to be followed. If a piece of furniture is replaced, it will be made in the same dimensions and finishes as those indicated in your order confirmation. Under no circumstances will we accept changes in measurements and/or finishes or repairs to the furniture on behalf of the client and invoiced to LUXURYLOFT DECORATION, SL.

Warranty

The guarantee and the after-sales service will be governed by the provisions of the Royal Decree 1/2007 of November 16, which approves the text of the general law for the defense of consumers and users.
LuxuryLoft Decoración, S.L. offers a guarantee of its products, in legally established terms, for a period of three years from the date of delivery.
In case of defective product, LuxuryLoft Decoración, S.L., will, as the case may be, repair or replace the product. These steps will be free for the consumer and the user.
This warranty will not be effective if the product has been exposed to high temperatures or inadequate moisture, as well as knocks or scratches.
To make use of the guarantee within the established legal period, you will need to present proof of purchase.

Force Majeure

LUXURYLOFT DECORACIÓN, S.L. will not be held responsible for any delay in the delivery of products if this is due to a circumstance of force majeure, including general, territorial or sectoral strikes, floods, fires, etc. .....

From LUXURYLOFT we would like to thank you for your understanding following the wave of COVID19 outbreaks affecting our workers, our manufacturers and our transporters.
Despite all the resources at our disposal, there is always sick leave, which has a direct impact on our work and causes some delays in production and deliveries.
There is a commitment, in any case, by LUXURYLOFT DECORACIÓN, S.L, that the delivery of orders is affected as little as possible, serving your order as soon as possible.

All products on this website, are custom furniture, having been manufactured according to their own specifications, and is therefore subject to the regulations contained in Article 103 c) of the General Law of Consumers and Users.

Other conditions

In case one of the clauses of these general conditions is declared void, the other clauses will remain in force and must be interpreted taking into account the will of the parties and the purpose of these general conditions.
The fact not to exercise LUXURYLOFT DECORACION, S.L. any right derived from the present general conditions, it will be never construed as one waives this right, which can only be done expressly and in writing.
